Gender inequality Essay Example | Topics and Well Written Essays - 1250 words
Gender inequality - Essay Example Western feminists, such as Rich argues that rape and violence against women are central to the control of women and their bodies, especially when the advancement of women in the public sphere is de-stabilizing this power base: Patriarchy is' a familial-social, ideological, political system in which men - by force, direct pressure or through ritual, law and language, customs, etiquette, education, and division of labour, determine what part women shall or shall not play, and in which the female is everywhere subsumed under the male. It does not necessarily imply that no woman has power, or all women in a given culture may not have certain powers.3 People ... whose lives cut unfamiliar paths across the distinctions of rule suggest still other structures of feeling in formation, other sites of power to identify, a wider range of sources to consider, and, not least, other kinds of memories to call on and stories to tell.4 When considering other theories of power, especially in relation to sexuality and race depends upon violence and control over the body, which is an indicator that there is inherent discrimination in the legal, social and political system. However, there is a lot of similarities in Western and Eastern cultures in respect to control and power over women's bodies. Carla Rice states that [w]henever we as women look at ourselves through the lens of culture, we' end up engaged in a war with our bodies, one that we cannot win. Society has inhibited our bodies and we have absorbed into our skin and bones (1999, 317) Stoler introduces an interesting connection between women's bodies and culture; however the modern restraints on women and the body are not new, i.e. history has restrained the body in differing ways. The modern era has heralded freedom in the sense of the mind; however culture has enslaved women using their body again, i.e. the reproductive functions were the prison of the past, superficial beauty is the prison of today. This imprisoning of the mind by using the body is a very old weapon used by the dominating male hierarchical system in fear that women can no longer be so easily controlled. If one considers cultures, such as Asia and the Middle East, being too fat or having a big nose is not a thing of consequence; because women are still imprisoned by their reproductive functions. The male dominated system of the West has been forced to alter cultural images and notions to further dominate women; therefore culture has had to alter by forcing women into a new box, i.e. an underfed , tall, big busted woman. The war waged on women's bodies is first a conflict over shape and size, over the terrain of our bodies, played in a deeply entrenched cultural taboos and a powerful dictate against women taking up space and claiming room of our own.5 This statement of Rice's sums up the conflict between the advancement of women and the restraints constructed by the male dominated culture, which has to adapt to the advancement of women in the late 20th and 21st Century. Rice is correct in her evaluation of the male dominated culture adapting to imprison women from declaring their own rights and space. Foucault6 has provided a discourse that has gone farther than just making women equal to men or races equal, by understanding that

Tortilla Curtain by U.S. author T.C. Boyle Essay Example for Free
Tortilla Curtain by U.S. author T.C. Boyle Essay The American Dream is defined in many ways in both of these works of literature.à What is the American Dream?à It is the idea that with hard work anyone can succeed in this country.à Succeeding is mostly defined in materialistic terms, like having a house in the suburbs, a new car, etc.à The American Dream is also about being able to support a family in a more-than-basic way. à It may also be defined as living a fulfilling life but of course, one needs a little money to do even that. à In Boyleââ¬â¢s Tortilla Curtain, the American Dream is shown as absolutely unattainable to some people, chiefly illegal immigrants, unless they are willing to break the law.à In the movie Crash, the viewer sees examples of people who ââ¬Å"make itâ⬠as well as people who donââ¬â¢t, and even some people who are in between.à However, in both these pieces, characters must struggle and work hard for even a chance at the American Dream.à But the question remains, ââ¬Å"why is the American Dream attainable for some and not for others?â⬠à Overall, the idea of the American Dream is shown as a myth or illusion for most people. à à à à à à à à à à à The American Dream exists in many ways in this movie.à In Crash, the viewer is shown a successful character like the Latino man named Daniel.à Daniel lives in a small house, but it is his house.à He lives with his wife and daughter.à He works hard every day, and while he will never be rich like Jean, he is able to survive and to sustain his family.à The viewer would not exactly view him as a success story because there probably isnââ¬â¢t much money left over at the end of each month.à However, the viewer recognizes that Daniel has what is truly important in life and is ââ¬Å"making itâ⬠even thought that might be day by day. On the other hand, the Persian man who owns the shop is unable to attain the American Dream.à Or rather, he is on his way when the shop is destroyed by vandals.à With the insurance company refusing to pay, he has lost everything.à Due to the fact that he has been ripped off before in America, he does not believe Daniel when he is told to get a new lock.à Therefore, he essentially loses his business.à Both of these characters must struggle through stereotypes and prejudice and racism on a daily basis to even have a chance at the American Dream. à à à à à à à à à à à Now, Jeanââ¬â¢s character in Crash shows another side of the American Dream.à She really has the plush lifestyle that most people would think of when defining the American Dream.à She has the beautiful house, the cars, the maid, the manicured lawn, the glitzy clothes and jewelry, etc.à She is clearly unhappy.à All of the material possessions have not made her happier; they have possibly made her miserable.à She has no friends, no one she can really count on.à for most of the movie, she is a hated character, and yet she is someone who lives the American Dream. The viewer does not know whether the couple has earned all this money or inherited some, but the viewer sees Jeanââ¬â¢s character basically doing nothing.à She does not work while Daniel and Farad struggle daily to make a life for their families.à Clearly, Crash says that the dream is not attainable for everyone no matter how hard they work.à Neither one of them is lazy characters at all and still, life is a struggle.à But those who have the ââ¬Å"lifeâ⬠want to protect it and protect themselves against those who donââ¬â¢t. à à à à à à à à à à à In Crash, there are those who sort of live the dream outside the boundaries of the law.à The viewer assumes that Ken Ho lives the dream.à he is an immigrant who has ââ¬Å"made itâ⬠in America.à But how has he done this?à He traffics human beings. He completely compromises any values that he had in order to make money.à à Ludicirs and Anthony sort of live the dream although they always must stay one step ahead of the police in order to keep what they have.à They steal cars which earns them money to buy nice things.à These characters show the American Dream gone awry.à However, there is a reality here as well.à Many people in this country feel that the Dream is unattainable to them any other way than breaking the law.à So, they break the law in order to get the things that others already have. à à à à à à à à à à à Basically the movie Crash shows the viewer situation after situation where people struggle to live the dream and that is exactly what it is for most people, a daily struggle.à To get to the top is hard enough, but to stay there is nearly impossible.à And it isnââ¬â¢t about hard work at all.à being a hard worker guarantees nothing in this life.à It doesnââ¬â¢t guarantee that a person will ever get anywhere financially.à It doesnââ¬â¢t guarantee that someone who hasnââ¬â¢t worked at all wonââ¬â¢t take your life away from you suddenly.à It doesnââ¬â¢t even guarantee that a person will have a place to live or money to buy food no matter how hard he/she works. à à à à à à à à à à à This brings us directly to Boyleââ¬â¢s Tortilla Curtain, which is yet another name for the border between the United States and Mexico.à In Tortilla Curtain the dichotomy between rich and poor is shown quite clearly.à Kyra Menaker-Mossbader and her husband and son have the American Dream.à They live in an exclusive housing development called Arroyo Blanco Estates and seem to have all the luxuries of life.à below their house, Candido and America Rincon live.à They came to America illegally from Mexico in order to maintain the American Dream.à they find that no matter how hard they work, they simply cannot attain the Dream.à In fact, they cannot gain enough money to live any semblance of a decent life. à à à à à à à à à à à The Rinconââ¬â¢s come to the United States illegally to work for a better life.à The Rinconââ¬â¢s truly believe that in American society ââ¬Å"everyone, even the poorest [has] a car, a house, and a TVâ⬠(26).à They do not understand that even Americans are poor; that is why America is so upset when she meets Mary at the labor exchange.à If citizens of this country cannot achieve the American Dream, where does that leave her family?à Throughout this book, America will come to believe that her whole idea was noting but an illusion, an illusion that will not be met. They have already reduced their living standards to the bare minimum and are barely scraping by.à While America is pregnant, she has had to camp out in the open air with no clean water or any sort of sanitation system.à This couple has no health insurance for the birth of their baby, nor do they have prospects in getting a job in order to obtain and maintain this health insurance.à They work as day laborers until they canââ¬â¢t even find work at all.à America is like many others.à She dreams of the United States we typically see in the movies.à She would like a ââ¬Å"clean white houseâ⬠with some modern amenities and a little yard. à à à à à à à à à à à Like some of the character in Crash, America commits a crime, although on a much lesser scale.à She steals fruit from a garden.à She has never before committed a crime.à But the desperateness of seeing those around her thrive while she struggles to eat is too much.à Sadly, also like many of the characters in Crash, they are also unable to defend themselves from attacks.à They are out in the open air and have a hard time with the language.à First, some kids smash up their camp for fun.à Then America is raped.à They go to the city where Candido is robbed, and they eat garbage to survive.à They return to their campsite in the valley and things are looking up until Candido accidentally sets the whole valley on fire.à Their savings are burned up, and they must start over once again.à Their daughter is born blind. à à à à à à à à à à à Kyra Mossbacher and her family have achieved the American Dream.à Have they worked harder than the Rincon family to achieve this dream.à The reader can clearly see that they have not.à It is simply that the dream is open to this family and closed to others.à Kyra Mossbacher has a dream of possessing even more.à she wants the Da Ros place which is a huge mansion ââ¬Å"in the style of an English manor house, comprising eleven thousand square of living spaceâ⬠(222).à Kyra must replace her ââ¬Å"dreamâ⬠after this place is destroyed by fire.à they live a charmed life with their young son and their pets.à They are sheltered from the cruel realities of what many others face in this life. à à à à à à à à à à à While Delaney calls himself a ââ¬Å"liberal humanistâ⬠(3), he has some chance encounters with Mexicans that slowly turn him into a racist. First, he runs into Candido with his car.à he is guilty at first and then angry at this illegal for being in the road.à Finally he hands him a $20 and calls it even.à à Apparently this is what an illegal immigrantââ¬â¢s life is worth, $20.à As other things happen, Delaney become angrier at Mexican illegals.à First, a coyote takes his dog.à then his Acura is stolen by thieves. His neighborhood also becomes angry and begins to wall in his community.à they are protecting their American Dream, but in doing so, they are stopping others from attainting this dream.à à Ironically, the people building these fences are the illegal immigrants themselves, like Candida and his friends.à Kyraââ¬â¢s lobbying closes the labor exchange.à he wants vengeance on Candido.à He goes to the campsite with a gun and a mudslide starts.à While Delaney saves Candido, the baby drowns.à The tragedy in the end of this book is beyond compare. à à à à à à à à à à à What the movie Crash and the book Tortilla Curtain teach the reader is that there are no easy answers.à Illegal immigration is not rationalized or approved of in any way, and yet, these people need to survive.à We all fight for the American dream, and we all want to protect ourselves against people who want to take from us.à That is human nature.à In Crash, the idea is that we crash into people because we are so starved for human touch.à Therefore, we have these chance encounters with people we never would have met otherwise; some of them are good and some are bad.à The average person struggles everyday and life isnââ¬â¢t easy. There is no such thing as equal opportunity in this country and hard work is not even remotely close to all that is necessary to achieve the American Dream.à In Tortilla Curtain, the same kinds of lessons are taught.à Delaney and Candido meet quite literally in a ââ¬Å"crashâ⬠scene, and Delaney describes himself as a liberal until he starts to fear those trying to get a piece of their own dream by disrupting his.à Then, he fights back.à It isnââ¬â¢t America and Candidoââ¬â¢s fault because they want to make a better life for themselves and their baby, and it isnââ¬â¢t really Delaneyââ¬â¢s fault because he wants to keep the life he has.à The story ends about as tragically as one could. à à à à à à à à à à à Both of these pieces tell the reader/viewer something about empathy.à Maybe if everyone could try just a little harder to understand the stories of others, to understand where others are coming from, we could solve some of our problems.à à Everyone wants the same things in the end.

jane austen Essay -- essays research papers fc
This 5 page paper considers the limited roles of men and women in Jane Austen's society and assesses the social conventions, enforced by gossip, that keep women in line. This paper specifically explores the characterization of Elizabeth Bennett in Jane Austen's Pride and Prejudice and argues that she is a representation of a modern woman in a nineteenth century world. 6 pages in length. Typical of Jane Austenââ¬â¢s novels, the author strives to portray a more equitable relationship between the genders. In Persuasion, the character of Anne represents Austenââ¬â¢s conduit amid women and the patriarchal society in which they have been compelled for centuries to exist. The writer discusses the manner in which Austen perpetuates the ongoing struggles with regard to gender oppression is of critical importance in relation to Anneââ¬â¢s character; indeed, hers is represented by the author as one who exemplifies the need for a favorable and fair approach to professional and domestic life. Children in the reception class Essay
The setting in which I am carrying out this assessment is a county infants school in the reception class. The school is located on the outskirts northwest of the town Ipswich. There are children altogether attending the school and there are twenty-eight children in the reception class. Inside the classroom there is space on the carpet for all the children to sit, there are tables and chairs but not enough for all of the children. They have regular use of a classroom (that will be used when the next year of children move up at Easter) and also the main hall. Outside there is a large playground with an adventure playground at one end containing climbing apparatus, there is also a medium sized field that is only used in good weather. The children in the school are all aged between four and seven years. The class I am focusing on has children in the age range of four and five. The class follows the Foundation Stage curriculum. Aim The aim of this assessment is to devise a medium term plan and to plan a range of activities and experiences that would benefit development for children aged between four and five years. The activities I will be planning will be closely linked to the six areas of learning from the Foundation Stage curriculum. Mind map-China this activity involves the whole class, they will all sit down in a large group and the teacher will sit at the front with a large piece of paper and a large pen. The teacher will ask for any ideas they know about the subject (in this case China) and write down any suggestions they have that are relevant to the subject. Rationale The curriculum plan I have designed is to be carried out over a six-week period. This plan is whatââ¬â¢s called a medium term plan, which is in more detail than a long-term plan (often done over a one year period). A short-term plan is more detailed than the medium-term plan and is often based on a daily or weekly basis. I am preparing this curriculum plan in the best way possible to promote the development in all areas. I have discussed with my placement supervisor about the suitability of my activities and also to have an incite on a curriculum plan already in order. I believe that children benefit best from having a wide range of activities and experiences, keeping the day interesting and keeping the childrenââ¬â¢s minds active. All of these would prevent boredom, straying minds and lacked concentration. My plan will be arranged around the fact that all children have different, but they all need to be treated fairly. The plan will be relevant to the age range four to five years because all the activities are planned for children just starting school that are working on the Foundation Stage curriculum. I will be making sure that my plan is age and stage appropriate by researching developmental norms/milestones, curriculum planning information and current curriculum plans that are being carried out. This needs to be done because otherwise the children will be under stimulated or they will not fully understand what they are doing or being asked to do. I decided on my activities by choosing two areas (communication, language and literacy and mathematics) and noting from my placement what the most effective methods of learning are there, then devising my own activities and made resources that are relevant. I will be discussing with my placement supervisor whether there are any changes that can be made or whether anything will be dangerous, biased, discriminative or harmful to the childrenââ¬â¢s health or safety. My chosen topic for my six-week plan is China (in particular Chinese New Year). The children will hopefully learn about the traditions that they have, presents and gifts they give each other, how they decorate their houses, about Chinese writing and speech and the style their houses and belongings are. They will also be learning the story of the animals, why they were racing and what order they came in. they will learn a new song that is about a Chinese boy and girl (the children can pick their names) and how they greet the greet their family on Chinese New Year day. The children will also be listening to Chinese style music and playing certain bars on the pentatonic scale that resemble said music. I hope to improve my knowledge of the subject medium-term planning. I will gain an understanding of appropriate activities and experiences that can meet all childrenââ¬â¢s needs and encourage their development. I will understand how to plan and implement the activities and use suitable equipment and resources. I will also be improving myself as a childcare worker in these circumstances. I will understand how I can help childrenââ¬â¢s learning. I will also learn how to relate activities and experiences to the early learning goals (ELG) The following are brief descriptions of four of the activities out of my curriculum plan: Mind map- the main area of learning this links to is knowledge and understanding of the world. For this activity the whole class will be involved, it starts with a large piece of paper (maybe with a picture) and some chunky marker pens. The practitioner asks the children what they know about the subject (in this case China). All of the childrenââ¬â¢s relevant suggestions will be written down leaving space to elaborate at the end of the subject. The practitionerââ¬â¢s job is to encourage the children and to write down what they say. This activity is mostly done to see how much the children know so the practitioner should not interfere or influence their answers. The only resources required are a large piece of paper and chunky marker pens. All the children have a fair chance to put across what they know, if some of the children seem to be dominating the activity, the practitioner will ask the quieter children whether they have anything to say.

Annotated Bibliography for Childhood Obesity Essay
Child obesity became a very serious issue that is taking on the health of the nationââ¬â¢s children. It is everyone responsibility to work on preventing and reducing childhood obesity, from the parents who are suppose to care about their childrenââ¬â¢s health, to the public health representatives, who should care about a future healthy nation, and everyone in between. Every part of society should create a set of lifestyle changes in order to save our kids from obesity. There are many aspects, which have to be changed or improved, including parentââ¬â¢s nutrition education, childrenââ¬â¢s physical activity and kidââ¬â¢s nutrition in a school and home, food industry and etc. Wiley, L. F. (2013). ââ¬Å"No Body Left Behindâ⬠: Re-Orienting School-Based Childhood Obesity Interventions. Duke Forum For Law & Social Change (DFLSC), 597-128. The article discuses the school intervention in childhood obesity. It suggests that school would be required to provide a minimum number of minutes of physical education every week. It is very important to make those classes accessible, enjoyable and stimulating for kids. The article also mentions that school lunches with a lot of fruits and vegetables are part of health promotion. It adds that many intervention in this sphere are already exist, but they need improvements, because statistic donââ¬â¢t show any result at this time. My assignment: The article indicates on moderating intervention on obesity in the school system. This idea can be used to support the argument that the school system is a important part of childrenââ¬â¢s environment and should create a set of changes to reduce obesity among this countryââ¬â¢s youngà generation. I believe this as one of the true aspects that society should concentrate and improve on. Murtagh L, Ludwig, DS. State intervention in life-threatening childhood obesity. JAMA 2011; 306(2): 206-207. This article is posing a solution offer from Murtagh and Ludwig on obesity in children. They suggest removing a specific subset of obese children away from their parents and placing them foster care as a remedy for their obesity on a stateââ¬â¢s law base. Dr. Ludwig and Murtagh assume that this action would change the direction of the childââ¬â¢s obesity by providing an opportunity be exposed to healthy nutrition and reasonable activity level for some period of time. At the same time, the information on how to manage childrenââ¬â¢s weight would provided to parents of those children. The article further states that ââ¬Å"under most existing child protective services laws, multiple less intrusive interventions such as in-home social supports, parenting training, counseling, and financial assistance, that may address underlying problems without resorting to removal of a childâ⬠. â⬠¨ My assessment: I think ââ¬Å"less intrusive interventionsâ⬠is better idea then removing a child from a family. The last one is an unnecessary action, and may be even damaging for childrenââ¬â¢s psyche. I donââ¬â¢t defend parents, I also think that parental role is important in childrenââ¬â¢s obesity issues. I agree that parents should get educated on how to provide healthy nutrition and reasonable activity level for their children. This article would support the idea in my paper that parents are also an important part of society that should be involved in a process of preventing and reducing childhood obesity. Koplan, J., Liverman, C. T., Kraak, V. I., & Institute of Medicine, (U.S.). (2005). Preventing Childhood Obesity : Health in the Balance. Washington, D.C.: National Academies Press.(p. 153-154) One chapter of this book tells us about how the food industryââ¬â¢s advertising and media affect childrenââ¬â¢s obesity and what changes have to be done toà shift its affect to the healthier side. The author of this book says that prevention of obesity in children should be a national health priority. All these recreational industries ( food, beverage, restaurant, entertainment) should share in the responsibilities for childhood obesity prevention and be instrumental in supporting this goal. For example, leaders of food industry could make changes to expand healthier options (reduce portion-size, reduce sugar amount in meals and etc.). Media should advocate healthy lifestyle . According to their studies it already stated changing , it has to continue going this direction. The chapter stays idea that all those industries should prevent obesity in children by developing and promoting products, opportunities and information that would encourage healthful eating behavior and regu lar physical activity. My assessment: This book will be used to underscore the idea in my paper that coordinated efforts among the recreational industries, government, and other groups would make easier to create, support, and sustain customerââ¬â¢s demand for ââ¬Å"healthful food and beverage products, appropriately portioned meals, and accurate and consistent nutritional information through food labels, health claims, and other educational sources.â⬠(Koplan, J., Liverman, C. T., Kraak, V. I., 2005, p.153). The book will be used in the sections where food industry and advertising could change their marketing toward healthy choices to help reducing and preventing obesity. Caroli, M., Argentieri, L., & Masi, A. Role Of Television In Childhood Obesity Prevention. International Journal of Obesity, 28, S104-S108. Retrieved June 1, 2014, from http://www.nature.com/ijo/journal/v28/n3s/full/0802802a.html ââ¬â aff1 This article is about the role of television in childrenââ¬â¢s obesity. Authors of the article say that children started watching more television then it was twenty-thirty years ago. Obviously it leads to inactivity and as a result to obesity. Furthermore, the article main point is television as a popular tool among children could be used for spreading correct information on good nutrient and obesity prevention. Authors mention that usually depiction of food in television has many negative consequences on foodà habits. In many cases, characters from movies or cartoons eat unhealthy food and provide bad examples to follow. The article supports its idea with studies. My assessment: I will use this article along with other information, when I write about media and advertising effects on childhood obesity. I agree with this idea. I think it is hard to fight food industry or technology market, but society can try to shift it to healthier side at least. Government and policymakers as power layer of society could help to change the situation. Wilson, D. Prevention in Obesity is Part of Childbirth Education. International Journal of Childbirth Education, 29, 4. Retrieved June 1, 2014, from http://www.icea.org/sites/default/files/April%202014%20Final.pdf In this article Debra Wilson tells that prevention of obesity should start from childbirth. She points that women who are overweight during pregnancy have higher risk to give a birth to a baby who would become obese. Many factors could lead to obesity for a baby that depends on motherââ¬â¢s responsibilities, such as maternal smoking, short-term or long-term breastfeeding and etc. In addition, she notes that parents are the ones, who provide food to children and teach them eating habits; they are fully responsible for childrenââ¬â¢s health. The author concludes that it is much easier and cheaper try to prevent obesity from the beginning, thatââ¬â¢s why childbirth educators can help with this. My assignment: This article will be used when I present how childhood obesity can be prevented. Further more, it shows how important the roles of parents are in obesity prevention. I will add this part as support for my point that every layer in society can be apart of changing the nations statistics on child obesity.

Comparing the Viscosity of Water and Engine Oil essays
Comparing the Viscosity of Water and Engine Oil essays Comparing the Viscosity of Water and Engine Oil The viscosity of both water and engine oil was determined. The method used involoved filling a bottle with water first and measuring the time a marble took to travel from one point to the other using a stopwatch. This was repeated for the engine oil. It was found that engine oil was more viscous than water. The minor discrepancy found in the results was due to the reaction time often existent when using a stopwatch. The aim of the experiment was to compare the viscosity of water and that of engine oil by means of a bottle, a marble and a stopwatch. The bottle was filled first with water and then its viscosity was determined. Then it was filled with engine oil and also its viscosity was calculated. Different liquids have different densities. This means that some liquids are denser than others. The density of a liquid is the extent to which its composing molecules are packed together. Density, r, is the mass of a liquid in relation to the volume it occupies. It can be measured using the formula below: where r is density, m is the mass of the liquid and v is its volume. Therefore, it follows that once the density of any liquid is determined, its viscosity index can be known. Another method of determining the viscosity of liquids is by comparing the flow of these liquids. Determining the viscosity index is very important for mechanical engineers because it allows them to design the right kind of viscous oil for the appropriate mechanical function. In the present experiment, the second method is used to determine the viscosity of both water and engine oil by calculating the time a glass marble takes to travel from one point in a bottle to the other using a stopwatch.. buy custom The Canadian Tourism Human Resource essay
buy custom The Canadian Tourism Human Resource essay In any part of the world tourism is a very dynamic sector that needs a lot of staff to succeed. Tourism needs people in all aspects of the tourist circuit and this poses an insatiable demand for the well trained personnel. In British Columbia, the human resource challenge brought about by dynamism is the fact that not many people working in the tourism sector have been specially trained. One may find a professional waiter taking on the duties of an usher when the demand arises. Some professionals are only needed when the demand arises and as such they result in taking on other jobs to fend for their families. According to Tourism Industry advisory council. (2006) most of the tourists visiting British Columbia are people who have prior experience in tourism having visited other parts of the world. They tend to compare the services offered in British Columbia with those they experienced elsewhere. This comes in total disregard to the numerous new opportunities and experiences that the country has to offer. The human resource well conversant with the country is thus found to be wanting in the eyes of the frequent traveler. Most of the people that work in the tourist attraction areas, in British Columbia have had no prior training in professional colleges. Rather, they have been trained on the job in the relevant institutions where they work. The human resource is rich in experience but lacks the fine touch that professional school training can offer. More and more establishments are beginning to value the training that comes with attending one of the few approved tourism colleges in the country. There are a couple of internationa training colleges that offer various courses covering the hospitality and tourism sectors present in British Columbia that train students. However, due to the dependability on seasons of the tourism sector in the country, most of them end up finding work in foreign countries. This is because competition is more dynamic in foreign countries leading to better pay for the graduates. This is not good for the long run since the tourism sector will end up lacking professionally trained staff (Propel Industry Credentials, 2008). There is also a large discrepancy in the employment numbers through the different sectors in the tourism industry. For instance, according to Canadian Tourism Human Resource Council (2011) the accommodation services required more than 66,000 members of staff as compared to 43,500 in 2001. The problem with this growth pattern is that it is unstable and as such it can record substantial increases in some years and steep declines in the following years. Another factor affecting the human resource in British Columbia is the inability for the sector to attract large numbers of talented individual to pursue careers in tourism and hospitality. This is mainly because the sector is still struggling and people look into pursuing strongly cemented careers that will guarantee success in both monetary and career growth aspects (McCallum, 2009). The food and beverage sector attracts more employees than any other sector in the tourism circle. Preliminary data for 2001 shows that tourism related employment in British Columbia stood at 14% of the overall employment in British Columbia. The rates have increased over the years to stand at 18% in the year 20099 (Canadian Tourism Human Resource Council, 2011 and The Canadian Tourism Human Resource Council and Capilano College, 2001)). This is evidence of the growth in the tourism thus it is important for the industry players to ensure that their establishments are ready to cater for the growing numbers. Tourism has also continued to attract tourists into British Columbia increasing at a rate of 11% in the last decade (BCJobs.ca , 2010). The larger numbers of these tourists are those who are attracted into the country for adventure tourism activities like skiing and golf. These are occasional adventurers who in turn require part time staff to take care of their needs during these ti mes. The tourism sector thus has to be flexible enough to accommodate these needs (Industry Canada, n.d). Projections have shown that employment in this sector is likely to reach 37,700 by 2012 and increase by a further 10,600 through to the year 2020. The annual employment growth rate is projected at 4.2%, though this figure is slightly below the growth rate experienced in this sector during much of the early 2000 (Go2, n.d.). The projections show numbers well above employment growth rates for other areas of tourism related industries. In conclusion, it is important for the industry players to take into account the different needs of tourists who frequent British Columbia and adjust accordingly (Kootenay Rockies, 2007). This will ensure that the current human resource remains employed and relevant in the sector if the tourists keep coming. Tourism is a very viable sector the world over and the staff in this sector need to be well taken care of to ensure that they remain in British Columbia to serve within it own boundaries (Victoria, 2006). Uncommon Author - An Interview with Eliot Peper
Uncommon Author - An Interview with Eliot Peper Uncommon Author - An Interview with Eliot Peper ââ¬Å"For someone who loves a book, would make their day? What would make them happy or make them think of it again or think that itââ¬â¢s cool? And Iââ¬â¢m always struggling with that.â⬠Update! We interview Eliot again for the release of the sequel to Uncommon Stock - come check it out!Eliot Peper is the nicest man in the world. At least, thatââ¬â¢s how we felt coming away from our interview. His first novel, ââ¬ËUncommon Stock,ââ¬â¢ a startup thriller, is both an indie success story and the debut book from Coloradoââ¬â¢s FG Press. Eliotââ¬â¢s background is in venture capital and consulting for the tech industry, including spells running his own startups. We met to talk about what it was like transitioning from entrepreneur to authorpreneur, and what it was like working with the newly-minted FG Press.Edit: As of 2016, FG Press has closed its doors. Eliot Peper is now a full-time indie author.- -REEDSYYour first novel is about startups. Youââ¬â¢ve had pl enty of experiences in the business world, but had you written much before?ELIOT PEPERI hadnââ¬â¢t written fiction since high school, but I had experience with storytelling. My background was in startupsââ¬Å - ââ¬Å I was a founder, then an early employee at a couple of different startups, and then an entrepreneur-in-residence at a VC fund. As you guys Iââ¬â¢m sure know yourselves, the fuzzy front-end of building a business, most of itââ¬â¢s storytelling. Youââ¬â¢re trying to pitch investors, youââ¬â¢re trying to bring in talent, youââ¬â¢re trying to tell people about the problem youââ¬â¢re trying to address; youââ¬â¢re always telling stories whether itââ¬â¢s to customers, investors, partners, team membersââ¬Å - ââ¬Å thatââ¬â¢s a lot of what you do on a day-to-day basis. So Iââ¬â¢d been doing a ton of that, but Iââ¬â¢d not been doing anything like writing a novel.REEDSYI thought it was interesting how widely your book was picked up by the b usiness community. A lot of business writing is generally non-fiction, right?ELIOT PEPERNon-fiction is interesting for obvious reasons. Most non-fiction is ââ¬Å"Here are the lessons I learned doing something,â⬠or with biographies ââ¬Å"What did this person learn through living their life?â⬠For business, I find fiction particularly interesting because it gives you this secret window inside the characterââ¬â¢s head.Thereââ¬â¢s a boatload of non-fiction out there about businessââ¬Å - ââ¬Å ââ¬Å"I built GM, or I was the CEO of X company, so here are the things you should think about when starting a company or in your daily life.â⬠But it doesnââ¬â¢t show you that, as Iââ¬â¢m sure you guys are experiencing right now, when youââ¬â¢re building a business itââ¬â¢s a human experience, right? Especially for founders who are struggling through their first company or their first couple of companies. Itââ¬â¢s a crazy emotional roller coaster. The hum an side of startups doesnââ¬â¢t get a lot of exposure because everyone wants to talk about advice and best practices. Few people want to talk about how it destroyed their relationship with their wife; or how they were sleeping with their co-founder; or how for their series B round they were about to get a ten-x valuation bump on the first round until lead investor had a heart attack the night before and it fucked up their entire company. That stuff happens all the time. Iââ¬â¢ve been shocked by the shit that goes down in Silicon Valley.People donââ¬â¢t talk about that stuff publicly in a non-fiction contextââ¬Å - ââ¬Å they donââ¬â¢t want to make that their sort of public life. The beauty of fiction is that you can experience that alongside the character. You can give people a window into what itââ¬â¢s like to be the startup or to be in business. And I think for people interested in learning about entrepreneurship thatââ¬â¢s really special because thereââ¬â¢s a lot more to it that just lean product development.REEDSYYeah, like you donââ¬â¢t need to have abstracted a principle for a story to be useful to someoneELIOT PEPERIââ¬â¢m sure you guys are experiencing this if you have advisors or mentors that youââ¬â¢re going to for advice. Youââ¬â¢ll talk to one guy and heââ¬â¢ll say ââ¬Å"Well, in my last business we did this, and we learned that you have to do X.â⬠Then you talk to someone else and theyââ¬â¢ll give you the exact opposite advice based on a totally different anecdote.A lot of business non-fiction is like thatââ¬Å - ââ¬Å itââ¬â¢s a lot of anecdotes, and itââ¬â¢s really easy to mythologise people. So you look at the big names like Steve Jobs or whatever, and once theyââ¬â¢ve achieved success it always feels like you can retroactively go back and say why they achieved success in the past. Thatââ¬â¢s a really weird thing to do. From a scientific process perspective thatââ¬â¢s really bad, b ut that essentially covers all narrative non-fiction. You have to have that ââ¬Å"What did you learn at the end of the fable?â⬠ending, and I think fiction gives you a lot more freedom in that sense. Youââ¬â¢re exploring just how humans wrestle with and overcome obstacles. Those obstacles could be killing Gilgamesh, or it could be taking a company public.REEDSYItââ¬â¢s like parables, basically, or Aristotleââ¬â¢s version of Ethics. He doesnââ¬â¢t try to say what bravery is, he just says ââ¬Å"Bravery is Achilles.â⬠ELIOT PEPERI think the human mind is wired to understand complex problems through stories. Itââ¬â¢s boring to read a complex problem that isnââ¬â¢t part of narrative.REEDSYHow have you applied your startup background to the daily routine of writing? I feel like a lot of startup advice is of the ââ¬Ëwork smarter, not harderââ¬â¢ variety. Can you apply that to writing?ELIOT PEPERI think the process of writing is very grinding, in terms of the actual drafting of the manuscript. I donââ¬â¢t even know how you would go about doing that smarter. I donââ¬â¢t really outline, I just spend time brainstorming constantly. On a walk Iââ¬â¢ll think about where the characters are, where things are heading, what the next scene should be, what the final scene should be. I feel like Iââ¬â¢m in good shape if I know the next scene Iââ¬â¢m gonna write, and some kind of North Star that the climax will be. If I have more than that planned out it usually gets stale or I donââ¬â¢t stick to it anyway. I have to spend time immersed in the world psychologically, then I sit down, start writing, and thereââ¬â¢s very little I can do aside from forcing myself to make the time, sit in front of Word, and not go on twitter. A lot of it is knowing how to be diligent and how to have discipline. That corresponds to business. Itââ¬â¢s way too prevalent with my friends in tech and the startup world who are like ââ¬Å"Oh my God I wa s up until 4am finishing this last release!â⬠To me thatââ¬â¢s like saying ââ¬Å"Oh my God, Iââ¬â¢m terrible at managing my time!â⬠You know, thatââ¬â¢s basically what youââ¬â¢re saying. It was less that I tried to take the lesson ââ¬Ëwork hard at all costs,ââ¬â¢ and instead take the lesson ââ¬Ëonly do what matters.ââ¬â¢ Thatââ¬â¢s really difficult to do.As an author itââ¬â¢s so easy to spend all my time blogging and emailing and pitching journalists or influencers to try and get more coverage for the book, to do events, to do signings, to just be on Twitter and Facebook or whatever promotional tools youââ¬â¢re using. You can let that suck away all your time. But at the end of the day the people who read my books, my actual readers, they just want the next bookââ¬Å - ââ¬Å they donââ¬â¢t give a shit what I post on Twitter. To an extent, me having a public face, at least they can feel like theyââ¬â¢re getting to know me.But you rea lly have to look back and say ââ¬Å"I need to be spending at least the majority of my time doing what actually matters.â⬠In business itââ¬â¢s just as difficult. Itââ¬â¢s very easy to spend your time just being external facing when the only reason people are going to be interested in you is to improve their lives by solving a problem. If youââ¬â¢re not solving that problem in what youââ¬â¢re doing every day, thatââ¬â¢s a problem.I think thatââ¬â¢s probably the one lesson I took from business. The ââ¬Ëwork smarter, not harderââ¬â¢ sideââ¬â¢s more relevant in the PR side of things and how you connect with readers. Weââ¬â¢re trying to experiment with that. I have a twitter account for the protagonist of ââ¬ËUncommon Stock.ââ¬â¢ We built a real website for the fictional startup in the book. We got Foundry Group, the VC firm, to announce an investment in them on April Fools day. Thatââ¬â¢s sort of fun. My dearest hope is that if I do something that delights my readers, that when theyââ¬â¢re at happy hour tonight and theyââ¬â¢re quaffing a beer, theyââ¬â¢ll say to their friend ââ¬Å"OK, they actually did this.â⬠If that happens thatââ¬â¢s one more word-of-mouth referral. Anything I can do to inspire or delight my readers, thatââ¬â¢s what Iââ¬â¢m going for.REEDSYIt seems like delighting a reader is much healthier than growth hacking.ELIOT PEPERYeah. If you look at the public discourse about how to get readers, the majority of it is the growth hacking kind of stuff. Itââ¬â¢s all about how can you engineer your own success and manipulate people into liking you, and I donââ¬â¢t knowââ¬Å - ââ¬Å I donââ¬â¢t really like to be manipulated as a reader, so I donââ¬â¢t really want to do that as a writer.REEDSYDo you have any role-models in the self-publishing space?ELIOT PEPERI like Hugh Howey. Heââ¬â¢s the wà ¼nderkind, right? But heââ¬â¢s also really personal and personable. He shares what he does, and it feels real. Or, you know Neal Stephenson? Heââ¬â¢s a prototypical Big 5 author; heââ¬â¢s been a best-selling author for decades, he has a huge audience, in that sense heââ¬â¢s very mainstream. But he writes on Slashdot and other random forums all the time. The people writing for the New York Times Book Review would never have heard of these places. Heââ¬â¢s interesting because if you go to his website, itââ¬â¢s pretty minimal. Itââ¬â¢s sort of lame. But heââ¬â¢s also on Slashdot and all these random place, writing super in-depth, honest answers to forum questions from trolls. I find that compelling because itââ¬â¢s like ââ¬Å"Thatââ¬â¢s pretty cool, youââ¬â¢re just being real, thatââ¬â¢s who you are, youââ¬â¢re a sort of goofy nerdy guy, you read Slashdot so you started writing there too.â⬠Itââ¬â¢s been very popular. His forum posts turn into memes that people share around writing blogsââ¬Å - ââ¬Å I think thatâ â¬â¢s fun.You donââ¬â¢t even have to stick to publishing. Macklemore self-published his first albums, was never signed by a major label, and was able to build a fan-base because his songs are awesome and he made funny videos for them. Now heââ¬â¢s turned that into having some of the top-listed songs over the past couple of years. Thatââ¬â¢s pretty cool, thatââ¬â¢s pretty fun. With the writers I admire most the biggest thing is they write really good stuff, but the other part is in the rest of their lives they come across as really genuine.REEDSYWhat sort of relationship are you building between yourself and your readers?ELIOT PEPERI try to think of writing as literally storytelling. I donââ¬â¢t just hand over the manuscript and thatââ¬â¢s that. I try to think of it like Iââ¬â¢m literally sitting at a campfire talking to people. If youââ¬â¢re sitting at a campfire with your friends, you donââ¬â¢t want to be awkward, right? Itââ¬â¢s better to tell a sto ry they want to hear. And afterwards youââ¬â¢re still their friend. Itââ¬â¢s not like the relationship is overââ¬Å - ââ¬Å youââ¬â¢re going to roast marshmallows over the fire and have a conversation about it. Thatââ¬â¢s how I look at being a writer. I can connect with my readers in a new way or share something with them they might not otherwise know. Like on my blog I write about business because some of my readers are interested in startups and thatââ¬â¢s part of why they read my stuff, but I also share personal stuff because if they like my book they might want to know more about me.Do you know Joss Whedon? I find him really interesting. Iââ¬â¢m not very sophisticated about films, but what heââ¬â¢s famous for is that while many of the shows heââ¬â¢s made havenââ¬â¢t been that popular in terms of ratings, the people who did watch it were obsessed with it. Heââ¬â¢s had the highest aftermarket sales of anyone. The prototypical guy for this is George Lucas. He turned a weird 70s sci-fi movie into the underlying mythology of America, and represents some enormous amount of toy sales and other crazy external licensing sales. The guys who are now doing all these superhero movies are obsessed with Joss Whedon because theyââ¬â¢re trying to do the same with these comic book franchises. So theyââ¬â¢re trying to take X-Men and turn it into these multiple blockbuster movies but also have video-games and all these other ways fans can experience the story. Joss says he has one question in mind that I think applies to every authors, and thatââ¬â¢s ââ¬Å"What can you do that would really delight your fans?â⬠For people who really like your story, how can you double down and give them extra stuff that they would just want more and more of if they really love that story? Thereââ¬â¢s a really wonderful essay on this, thatââ¬â¢s also relevant for early-stage entrepreneurs, called ââ¬Ë1000 True Fansââ¬â¢.Iââ¬â¢m still figuring that out. If people read Uncommon Stock, what more would they want? I know theyââ¬â¢d want the sequel because theyââ¬â¢re all asking for it, so thatââ¬â¢s goodââ¬Å - ââ¬Å Iââ¬â¢m working on that. But beyond that what are other things that, for someone who loves a book, would make their day? What would make them happy or make them think of it again or think that itââ¬â¢s cool? And Iââ¬â¢m always struggling with that.If I was constantly thinking about how I could sell more books, I wouldnââ¬â¢t enjoy the experience of being a writer much. If I want to look at the world cynically, my experience becomes cynical.REEDSYItââ¬â¢s a bad filter on the creative process.ELIOTYouââ¬â¢re going to have a filter no matter what. If your filter is ââ¬Ëhow can I create something that people will love,ââ¬â¢ thatââ¬â¢s a fun filter to have. If your filter is ââ¬Ëhow can I create something that people will buy, not only is that less fun from the creativ e perspective, but itââ¬â¢s also very difficult to ascertain. Itââ¬â¢s not obvious what people will buy. If youââ¬â¢re trying to select for that, it doesnââ¬â¢t mean youââ¬â¢re going to have any higher chance of success than someone whoââ¬â¢s just trying to create something that people will love, and theyââ¬â¢re going to have a much better time doing it.REEDSYYou worked with FG Press on ââ¬ËUncommon Stockââ¬â¢Ã¢â¬Å - ââ¬Å what was that like? Did it free you from the commercial pressures traditionally published authors work with, like having to earn out an advance?ELIOTFirst of all, FG Press gives no advances. You have a 50/50 split on all royalties. A typical big-5 contract gives the author about 15%ââ¬Å - ââ¬Å thatââ¬â¢s fancy math, but thatââ¬â¢s more or less what it breaks down to. FG Press is giving a much larger cut on royalties and theyââ¬â¢re giving no advance, and I wanted it that way. I think the advance system sets up the wrong in centive. Then the author is writing a book and selling it to a publisher, rather than selling it to a reader. The people who are important to me are my readers. My publisher is important to the extent that they help me either produce something better or do something that makes my readers more happy. I would self-publish in a heartbeat if FG Press was not providing those things for me.The commercial pressures are tied to advances, but the reason that authors are subject to those pressures is because they want the advance. Thatââ¬â¢s where things can get messy, and thatââ¬â¢s part of what FG Press set out to try to do differently. Does that create different challenges? Of course. If youââ¬â¢re not giving advances, the writer has to support themselves until book sales start coming inââ¬Å - ââ¬Å if they do. Thatââ¬â¢s not a universally good decisionââ¬Å - ââ¬Å you need to choose which risk factors you want to take on to produce the kind of content you want to make. T hatââ¬â¢s what theyââ¬â¢re doing, thatââ¬â¢s their model, and thatââ¬â¢s why itââ¬â¢s different. Theyââ¬â¢re betting that authors who publish through them willingly want to build a readership and want to earn money based on how popular the damn book is, regardless of whether a high-level editor thinks you have potential.REEDSYWhat is FG Press offering their authors in exchange for the initial 50%?ELIOT PEPERFirst of all theyââ¬â¢re writing the checks for the initial production costs. Itââ¬â¢s true, they take that financial risk, so thatââ¬â¢s great for authors who canââ¬â¢t write the checks to take the risks for editing and production. Thatââ¬â¢s useful and it shows that theyââ¬â¢re committed to the title. It just doesnââ¬â¢t cost that much to produce a book. The part where they really add value is through helping to establish a community of readers. As aââ¬Å - ââ¬Å very personalââ¬Å - ââ¬Å example I was sharing my book with Brad becaus e I thought he would like it, and heââ¬â¢s a well-known guy among people who might also like it. If he likes it and writes a review of it, it could be really useful for helping me connect with new readers. When I wrote the book and we released it, that was super useful. Not only did he post about it but he talked to TechStars. TechStars bought ââ¬ËUncommon Stockââ¬â¢ on a license for all of TechStarsââ¬Å - ââ¬Å present and future founders. So every TechStars person now gets sent a digital copy of Uncommon Stock. Iââ¬â¢d have never been able to achieve that on my own because I donââ¬â¢t have those relationships and I donââ¬â¢t know those people. But working with FG Press it was really cool to be able to do things like that. Or as another example, Foundry Group issued a fake investment. Would they have done that if I was a random self-published author? Probably not, right? So there have been many opportunities working with them for serendipity in terms of working with them that have definitely benefitted me hugely and that I really appreciate that I think also benefit readers. That was a cute stunt, and I wouldnââ¬â¢t have been able to do that for readers.Honestly, the way that I see it at the end of the day and the way that I think FG press is trying to build themselves and the philosophy they take to the table is that they want to just create a publishing model that makes common sense for authors and book production, and then they want to treat everyone like a friend. Iââ¬â¢m doing a panel at a tech event. I called FG Press and said ââ¬Å"Guys, I have this opportunity with this big panelââ¬Å - ââ¬Å wouldnââ¬â¢t it be fun if we could like get excerpts of the book to everyone going?â⬠So weââ¬â¢re creating this co-branded landing page where everyone can go pick them up if they want to. Then FG Press said ââ¬Å"If youââ¬â¢re looking for people for the panel, here are a couple of CEOs in the Foundry portfolio that cou ld be a good fit.â⬠So thatââ¬â¢s awesome, it makes the panel even better. And so I get to meet a bunch of CEOs who give me good material for my sequel. Itââ¬â¢s an all-around everybody-wins.REEDSYHow important was it working with an editor?ELIOT PEPERFirst of all, I need an editor, and I think anyone who thinks they donââ¬â¢t is crazy. If you want to produce something thatââ¬â¢s really fun to read, it needs to be edited by someone who knows what theyââ¬â¢re doing.I had a couple of different stages. I shared the drafts with Brad but he wasnââ¬â¢t providing on-going feedback and I didnââ¬â¢t want him to. When Iââ¬â¢m working on my first rough draft feedback slows me down, it doesnââ¬â¢t speed me up. I need to basically vomit onto the page, and then take that sack of shit in Word format and try to make it better. My first filtration process to try to make it slightly better was sending it to a couple of beta readers who Iââ¬â¢d been really selective with. These were people who I had to trust would both be super honestââ¬Å - ââ¬Å not just say it was nice or whatever. I had to know that theyââ¬â¢d give me lot of constructive negative feedback. They also each had a specific perspective they could add. One of them for example was probably the top Angel investor in San Diego, and he also studied Literature at Stanford. And so he has this dual perspective of knowing a lot about the English language and loving books, but also being very involved in tech and early-stage startups. I had a friend from grad school, who ended up being my developmental editor, who used to be an editorial exec in Hollywood. She had the whole movie perspective on how those structured plot elements. Movies are incredibly structured stories, and I donââ¬â¢t know that stuff. Having her perspective to help inform where the story could be improved was really useful. They sent back feedback in different forms. Some sent an email with high-level thoughts, s ome people sent me page references. I thought it through, took it on balance, incorporated it.Then I wanted to do a more in-depth, structural look at it because, as I said, I donââ¬â¢t really outline. Thatââ¬â¢s how I feel comfortable in the creative process but it means more work at the end because you end up having things that donââ¬â¢t work or donââ¬â¢t make sense or arenââ¬â¢t tight enough in terms of plot and character development. So I did three rounds of developmental editing with my friend from grad school. We made a lot of notes, had a couple of phone conversations, and then I would go through and address the problems I thought were important. We did three of those, and each got more gritty. The first one, she didnââ¬â¢t even make notes. She read it, wrote down thoughts, talked through some of the high-level issues. The next one was more scene-oriented, and the final one was more paragraph-by-paragraph.Once we were done with that, I did one more round of b eta readers, different people, got different feedback, incorporate itâ⬠¦ and thatââ¬â¢s when Brad was giving a lot of detailed feedback. Finally, once we were satisfied with the content we moved onto language. So I did a round of copyediting, then two rounds of proofreading before formatting it for Kindle and print and all that.REEDSYThanks for your time Eliot.

Firm expansion in the U.S Essay Example | Topics and Well Written Essays - 500 words
Firm expansion in the U.S - Essay Example The company lacks experience selling outside its regional comfort zone. A strategy that could help the company quickly penetrate other US markets is to formulate a strategic alliance with a competitor. The competitor should be a medium to large size firm that has an established network of distribution across all parts of the United States. This option can help the company increase sales volumes, but the profitability of the firm will be lower because the partner has to get his cut of the earnings. The strategic alliance deal should be negotiated in a manner that the company does not give up too much of its profits. Offering an equity participation in the company can persuade the partner to get a lower margin of the profits. A second strategy that the company could implement to expand its sales though out the United States is the implementation of an aggressive online marketing strategy. Ecommerce in the United States in 2010 reached sales of $153 billion (Plunkett Research, 2011). Th e company has a lot of good products that could be very attractive for online customers. A way to increase sales is by getting a freelance workforce to help increase the sites traffic and sales.
Statutory and Case Law Essay Example | Topics and Well Written Essays - 2000 words
Statutory and Case Law - Essay Example The word statute typically refers to a law, e.g., The Patriot Act, passed by a state legislature or the U.S. Congress that commands, prohibits, or declares something. It is sometimes called legislation. State and federal court cases often involve statutory interpretation, and enactment of a statute may well reverse an established case law precedent. Nevertheless, it is easy to overlook the importance of statutes in law school because most law school discussions focus on case law. The tools and techniques used to research statutes are similar to those used to research federal and state constitutions, treaties, administrative rules, executive orders, uniform laws, local charters and ordinances, and court rules. Statutory research may thus mean finding and analyzing any of these documents. All statutes are the product of congressional hearings thus the process is explained herewith. Congress consists of 535 men and women (100 Senators and 435 Representatives), each performing a delicate balancing act between the needs and demands of their constituents, their political parties, their contributors, their staffs, the Administration, and even each other. These often conflicting demands can simultaneously pull members of Congress in dozens of different directions on any one issue. It is against this backdrop that legislative process, or the passage of a bill into law, occurs in the two Chambers of Congress. These laws are called statutes. Congress is collegial, not hierarchical, and power and influence in administration decision making tend to flow in all directions. Although the How a Bill Becomes Law chart is useful in understanding the general legislative process, it is not a defined roadmap. Since no two bills ever follow exactly the same path to enactment, you always have to rethink the chart with every bill you research, keeping in mind the parliamentary and political maneuvering that can occur anywhere in the process. The life of each Congress is two years and each Congress has been numbered since the first Congress in 1789. The 104th Congress, for example, convened in January 1995 and ran until October 1996; the 105th Congress began in January 1997. Since World War II, the two-year Congress has been divided into two sessions (first and second), each lasting one year. Prior to the 77th Congress (1941-42), there occasionally were three or four session Congresses; some of these sessions were for a very short duration, sometimes lasting only a month or less. The numbering of Congressional publications is sequential within each publication type, beginning with the number "1" in every Congress. This means that each Congress will have a bill numbered H.R. 1, thus knowing the number of the Congress is important. Bills not acted upon when the two-year Congress adjourns sine die are considered to have expired. To be considered in the next Congress, these bills must be reintroduced and numbered in the new Congress' sequential order of bills. Hence, H.R. 1 from the 104th Congress can be very different from a bill numbered H.R. 1 from the 100th Congress. Knowing the Congress number is imperative for identifying the proper H.R. 1. The following describes the process by which statutes are created: Bill or Measure General legislation is designated by "H.R." in the House of Representatives and "S." in the Senate. Themes Of Landscape And Wilderness In Cinematic Films Essay
Themes Of Landscape And Wilderness In Cinematic Films - Essay Example 2. Examine the scope of landscape and wilderness in films. 3. Highlight the nature of landscape and wilderness as characters within films. Despite the progressive change, which land undergoes, two key predictions can be made about land, especially with regard to the establishment of new landscapes: i.e. landscapes transpire in light of peopleââ¬â¢s expectations, as well as their previous encounters, or landscapes evolve from a shift in mindset and from a changed connection between the environment, society and self. This means that changes that are embedded on a landscape are not typically similar to changes that are wrought on land. According to Sobieszek, the theme of landscape has undergone a dramatic change since early times, especially between the 1950s and 1980s. It is clear that a relatively new order of landscape has engulfed cinematic films that seem to take hold of the imagination of not only the writer and film director, but the audience, as well. The radical change in the perception of landscape is that from a solid yet permanent view to one that is marred by treachery and transmutation. In essence, differ ent media create new landscapes. For instance, in the film Walkabout of 1971, Roeg offers what can be perceived as a typology that showcases photography of locations such as Australian auk lands in the late 20th century. Roeg embodies a formalist concept by rendering the settings of landscapes devoid of human presence through settings such as deserts, flat horizons, vacant highways and fields (Harper and Rayner, 2010, 71). All these locations convey an essence that is at odds with the echo of Hollywood fictions. This allows films to level the meanings that they are originally meant to convey. Landscape in cinematic films adopts quite a different stance compared to still images, which are frozen depictions of landscape. Landscape in cinematic films incites the feeling of culture and cross-over between popular cinema and photography. Historically, landscape is initially associated with painting, and this is evidenced by the numerous depictions of landscapes in exhibitions and art muse ums around the world. Launched in the seventeenth century, the portrayal of emerging infrastructures of channels, harbours and roads that ran through sheltered country sides illustrates the claim that landscape depiction and description through picture is a product of the shift from feudal to capitalist economies (Harper and Rayner, 2010, 58). This paper argues that landscape facilitates new perceptions and venues of analysis and interpretation of cinematic films. Simply put, landscape emerges when the setting becomes the subject of the cinema rather than an object within the entire cinematic film. When applied to films, landscape enables a variation from plot, characters and psychology towards elements that are rarely taken into account in mainstream film. The main challenge thus becomes the discussion of landscape as a comprehensive expression in its own right, as well as its own agenda in other instances. Landscapes can be appreciated as encompassing numerous interacting ideas, t raditions, as well as inventions rather than something that is either out there or can be fixed on films. This paper will conduct a discussion within the realm of films over the period between the year 1970 and 2009. This is a period marred by a number of uncertainties and upheavals, as well as immense successes in the media industry and especially with regard to films. Through this period, there has been immense focus on film and landscape as avenues of the contested perception of individuals, and how film makers investigate the practices, properties and traditions of global cinema that is
Law of Contract (case study) Case Study Example | Topics and Well Written Essays - 1250 words
Law of Contract ( ) - Case Study Example ess was examined in the Heron II. This casenote explains the judgments in the Heron II, paying particular attention to the division of opinion among the Law Lords in relations to the degree of probability required in the test of remoteness. The second limb of Hadley requires the court to consider the degree of probability necessary to attract liability. Indeed, the degree of probability was considered in the Heron II and it was on this point (i.e., the degree of likelihood of an event which had to be contemplated by the parties at the time of contract) that the Law Lords' opinion differ.8 Lord Reid argued that although the shipowner was not aware that the charterer wanted to sell the sugar promptly on arrival, he knew that there was a sugar market at Basrah. Thus, if he had thought about the matter, he must have realised that it was not unlikely that the charterer wanted to sell the sugar. ... He must have also known that in an ordinary market the price of sugar fluctuates daily, meaning that if the cargo arrived late, it would affect the price which the charterer could obtain for his goods. Therefore, the question for decision was whether a plaintiff could obtain damages for loss of a kind, which the defendant ought to have known was not unlikely to result from a breach of contract.9 To answer this question, Lord Reid went through the reasoning of Alderson B's in Hadley. He interpreted Alderson B's judgment to draw a distinction between results of a breach which were likely because they would happen in the great majority of cases, and results which were unlikely because they would only happen in a small minority of cases. A defendant would be liable in the former case since the result should reasonably be regarded as having been in the contemplation of the parties.10 Applying Alderson B's distinction, he decided that a party in breach was liable for any loss arising from a result which was contemplated as "not unlikely".11 Applying the first limb of Hadley, Lord Morris considered if the loss suffered by the charterers could reasonably be said to arise naturally from the appellant's breach. He found that although the appellant did not know of the charterers' precise plan, the appellant had instruction "to proceed at all convenient speed to its destination".12 Hence, at the very least, the appellant should have contemplated that if the vessel was late, the charterers might suffer some financial loss.13 In other words, the appellant need not know that a loss to the charterers was certain or inevitable to be liable. He need only know of a possibility of loss.14 Lord Hodson also probed into the meaning of

Strategic finance with word counts no less than 1500 - Essay Example Like any other capital budgeting model, CAPM has its own weaknesses and strengths. In order to improve its usefulness, the standard capital asset pricing model has undergone various developments and modifications in the recent past. Since its conception about four decades ago, the Capital Asset Pricing Model has been used widely in applications to estimate cost of capital of firms and evaluate the performance of asset portfolios in companies. This report argues that CAPM has received such a wide support and use in the industry despite its strong assumptions because it provides powerful and reliable predictions about risk measurements and the relationship between risk and expected return. CAPM has several problems which are considered by many as the results of theoretical failures emanating from the strong assumptions of the model (Rubinstein 2006). However, they could also be caused by the difficulties of its empirical implementation. Although these problems are common, it is also understood that other models have their problems too. Therefore, the best model is the one which has proved to be successful in its application. Capital Asset Pricing Model is the model with such wide and successful application becaus e it provides powerful and reliable predictions about risk and returns of a given portfolio of assets. The Capital Assets Pricing Model (CAPM) suggests that the equilibrium rates of return of risky assets in the market have a linear relationship with the market portfolio. CAPM is used to establish a theoretical value of required rate of return of an asset in a diversified portfolio. This takes into consideration the systematic and market risks which are non-diversifiable risks (Rubinstein 2006). The model also considers the markets expected return and the theoretical risk-free assets expected return. CAPM draws from the portfolio theory developed by Harry Markowitz (1959). The role of the court Essay Example | Topics and Well Written Essays - 4000 words
The role of the court - Essay Example This is clear from Article 22/1 of this law, where it states that "the competent court may, upon the request of either party, order provisional or precautionary measures prior to commencing arbitration proceedings, or upon request by the arbitration tribunal during arbitration proceedings". In this article, rights are limited to the Arbitral Tribunal during the arbitral process without mentioning the rights of the two parties at this stage. This is confirmed by the division between these cases with the preposition "or", which in this context conveys the meaning of differentiating between the two matters. 1.1.2 Gathering Evidences Article 22/3 of the SAL 2012 states the right of the Arbitral Tribunal to request interference of the competent court or any competent agency in order to assist the tribunal during the arbitration procedure. Summoning a witness or rendering documents are examples of this in effect.1 This is also contrary to the former law, which did not contain any similar provisions. Among its provisions, the SAL 2012 does not include granting either party the right of such a request from the competent court. ... Based on the SAL 2012, it is admissible whenever arbitration is commercial for two reasons. First, the provision of Article 2 of this law states the applicability of the provisions of this law to each event of arbitration carried out in the Kingdom and international commercial arbitration held abroad. The second reason is that Article 22, which contains the stipulation of gathering evidence and issuance of Interim Measures, includes general provisions as it does not differentiate between domestic and international arbitration. This is in contrast to the Model Law, by which the Saudi legislature is inspired, states that requesting the assistance of the competent court occurs in place of arbitration.2 This confirms that the Saudi legislature intends to allow the request of this intervention if the location of arbitration is only in the Kingdom. Otherwise, it would have been mentioned as an essential point in the Model Law. Confirmation of such an assumption, and also the Saudi legislat ure intends to in respect to gathering evidence, is based on the rules of Sharia, which form a large part of the constitution of the Kingdom and should not be violated by any law.3 For any Muslim requested to testify and render a document that helps to clarify the truth, he must do so under this law.4 Otherwise, he would be condemned.5 In general, Sharia does not discriminate between the seat of arbitration and the nationality of the beneficiary.6 1.1.3 Extending The Duration of Arbitration Contrary to the former law, and even the Model Law, the SAL 2012 grants either party the right to request to extend the duration of arbitration after the expiration of the period stated in the arbitration agreement, or that which is stipulated by the law when

Green Acres Seed Company Assignment Example | Topics and Well Written Essays - 500 words
Green Acres Seed Company - Assignment Example Being advanced in technology, Green Acres Seed Company has to provide awareness to the farmers so that their seeds can be known by many. Through marketing of Green Acres seed using the modern technology of marketing, the company retargets those who visit the website thus keeping the products top of their mind. The company uses test messaging to convince the farmers about the seed company explaining the different varieties of seeds available with their prices. Green Acres Company like other companies has market segmentation for instance the company adopted performance segment which shows the characteristics of the farmers who are concerned with how corn seeds yields in the farm. Potential performance segment consist of farmers who have favorable attitudes towards the company and they do rely on the information given by the company. Dual purpose segment are those farmers who grow both grain and silage and they use both varieties and the last segment is price segment which consists of t hose farmers who purchase low priced varieties for silage and grain corn. Green Acres do target the four segments in the market so that competition can be reduced. Green Acres Seed Company has different prices. For example, seed corn price ranges at $90 per unit from $75 per unit to $125 per unit. The prices keeps on changing from better performing varieties to poorer performing or discounted varieties.Ã Ã Ã Ã One of the recommendations that I would like the company to take into considerations is to make sure that advertising of the company is done appropriately due to competition. For example the Pioneer company which made a sales of $80 million per year (Thomas, 1997). Other competitive companies are Novartis and Dekahlb which had more than 13 percent compared with Green Acres which had 11 percent. Due to the sales of Green Acres Company being low year after year, I recommended that the company spends more on adverting to make sure that the company expands its share of the market for silage corn seed. If Green Acres will advertise corn seed, then it will benefit from market share that will be high. Another recommendation that I would like to be considered is to make sure that more outlets are available in different regions especially in the developing countries.

Monetary Policy vs. Fiscal Policy Essay Example for Free
Monetary Policy vs. Fiscal Policy Essay People always struggled with an idea of prosperity and success, whether it was a personal goal or whether it was something major like wealth of a country. Nowadays, we are studying a science, which is really significant and valuable Economics. Economics is a tool for achieving those goals, knowledge that people can use and imply in real life, and at the present time probably undividable part of governments performances around the world. For us, students, there are two different matters we study Macroeconomics, the study of the performance of national economies and Microeconomics, which focuses on the behavior of individual households, firms, and markets. During the fall quarter of 2001, I was exposed to the basic ideas and uses of the Macroeconomics. Macroeconomics policies government actions to improve the performance of the economy are of particular concern to macroeconomists, as the quality of macroeconomic policymaking as a major determinant of a nations economic health. Monetary and Fiscal policies are two policies that we were concentrated on, and were the most significant part of the course for me. There is too much involved in these policies and they interact with each other consistently. I decided to write this paper, summarizing the basic functions of two policies, tried to explain what it is that makes them work, how effective these two policies can be, and how one relates to another. In looking at the effectiveness of Monetary and Fiscal policies, it must be understood how the two relate to each other within the government structure. The Federal Open Market Committee FOMC is the most important monetary policy-making body of the Federal Reserve System. It is responsible for the formulation of a policy designed to promote economic growth, full employment, stable prices, and a sustainable pattern of international trade and payments. The seven Board members constitute a majority of the 12-member Federal Open Market Committee, the group that makes the key decisions affecting the cost and availability of money and credit in the economy. The other five members of the FOMC are Reserve Bank presidents, one of who isà the president of the Federal Reserve Bank of New York. The Board sets reserve requirements and shares the responsibility with the Reserve Banks for discount rate policy. The FOMC is the policy arm of the Fed and the tasks of the Federal Reserve are to sup ervise banks, fixing maximum rates of interests. The U.S Treasury, though it aids in much of the monetary management, represents the fiscal sector, which is the U.S Congress. Fiscal policy covers, such areas as taxation and other revenue gathering and spending measures. Fiscal policies are those actions that are enacted by the Legislative Branch of the U.S government, the Congress. Their fiscal policies are enacted through the U.S Treasury. Therefore, the Treasury is the arm of fiscal policy and the Federal Reserve is the arm of monetary policy. For example, even if Congress has allocated some amount of money to take over failing banks and savings and loans, and it is not enough, than the Fed can pump capital into the system by buying bank stocks. So, this is example of how the Fed interacts and influences the ups and downs of the economy. In looking at the relationship between the Fed and The Treasury, essentially, the Fed was set up to provide the U.S Treasury with a more satisfactory fiscal agent. In acting as the fiscal agent for the U.S Treasury, or more specifically, as the primary banker for the federal government, the Fed acts as Financial advisor, depository and receiving agent, agent for issuing and retiring treasury securities, agent for other transactions involving purchases and sales of securities for Treasury account, agent for the government in purchasing and gold and foreign exchange, and lender to the Treasury. The Treasury influences monetary and credit conditions as well, through its revenue and expenditure policies, its debt management policies relative to the size and location of its money balance, and so on. As an instrument of monetary management, the Treasury keeps its money balance in cash in the vaults as Treasury deposits at the Federal Reserve, and Treasury deposits at commercial banks. Owing to the degree of Treasury operations, these policies have marked effect on monetary and credit conditions, especially over periods. Ordinarily, the Treasury does not use these powers for intentional and continuous monetary management; this is primarily the function of the Federal Reserve. However, it does try to use its powers in such a way as to avoid creating serious problems for the Federal Reserve, and on occasion, it uses them intentionally to supplement Federal Reserve policies. The following is an example of how this occurs. The Treasury can implement restrictive actions. For example, the Treasury increases it money balance $1 billion by taxing the public or selling securities to the public. When the Treasury cashes the checks, the public loses $1 billion of its deposits. If the Treasury holds these deposits at commercial banks, this is the extent of the effect; the reserve positions of the banks are unaffected. But if the Treasury uses the $1 billion to build up its cash in vault or its deposits at the Federal Reserve, member banks reserves will be reduced by $1 billion. Basically, if we find an increase in the Treasurys money balance, this tends to be restrictive unless the Treasury acquires the extra money by borrowing from the Federal Reserve. If it acquires the money balance by taxing the public or selling securities to it, the publics money supply is directly decreased. If it acquires money by selling securities to commercial banks, the publics money supply is not directly decrease, but the ability of the banks to create deposits for the public is reduced because they must use some their reserves to support the Treasury deposit. However, given the size of any increase in the Treasurys balance, the degree of restrictiveness depends on the form in which it is held. On the other hand, the Treasury can affect monetary policy, by easing restrictions as well. Sometimes the Treasury utilizes liberalizing actions in a positive way to ease credit to supplement Federal Reserve actions. More often, however, it uses them to avoid creating conditions that wo uld make the job of the Federal Reserve more difficult. Given, this information, we can see what the relationship is between theà Federal Reserve and the U.S Treasury. They often complement each other and balance each other out. However, the prime job of the Federal Reserve is to act as the federal government bank, as well as regulating monetary policy, credit regulations, and supervising function of member banks. The U.S Treasury is the element of the government, which collects money from the public, either through the sale of securities or through taxation. The U.S Treasury is that arm of the government, which provides the government with money it needs to operate, which of course is part of fiscal policy operations. The Fed is the bank that the Treasury uses for its banking needs, to be it in the most simplistic terms. *** We were all shocked by tragedy that happened on September 11, 2001. There was a tremendous impact on the entire world by that event. People were heavily affected emotionally same as financially. Many lives were taken by the coward act of those who responsible for such disaster. The US faced a number of consequences followed by many bumps on its way to the future. Unbelievable economic downturn made all sectors of the economy to suffer this impact and force them to make decisions, which they probably didnt thought of. Because Fiscal and Monetary Policy have a straight connection to the several actions taken by the government to stimulate weakened economy, I decided to cover what is going on right now within government structure and briefly explain what people should expect from policymakers, who are doing their best to respond to these obstacles, which we are facing right now, as quick as possible. Considering that todays U.S. economy is already in mild recession and many indicators show it might face the most severe economic downturn since 1970s of the last century, President Bush and his administration called for additional stimulus package for fiscal 2002. Policymakers in Washington are considering a number of actions that could stimulate the economy. Among them the options being considering are tax cuts that could spur consumption or investment, and additional federal spending that could directly increase economic activity. Republicans are the majorities in the House ofà Representatives and Democrats, who control the Senate, have very different and opposite visions about ways to stimulate the U.S. economy. Republicans consider that economic growth is generated through investments by businesses, which encouraged by cuts in taxes and tax rates. Democrats support the proposal that stimulates consumer spending such as through tax rebates for low-income, extensions of unemployment insurance, and government spending to promote construction and other infrastructure. A several weeks ago, the House Ways and Means Committee have passed a $100 billion economic stimulus package main part of which 85% for permanent tax cuts, mostly for corporate tax cuts. The major components of this plan are: Elimination of the corporate alternative minimum taxes and refunds AMT credits. This is a most controversial point of the House Republicans proposal. The minimum tax was designed to make profitable companies to pay a basic amount even if they owe no corporate income tax because of some deductions. Democrats support the fairness of this tax cut but disagree with its retroactive method because although these refunds would effectively reduce the tax rate on corporate income but those compensations for the previous investment, not new investment. Permit 30% immediate expensing write-off for purchase of capital assets over the next three years. Reduce the maximum tax rate on long-term capital gain from 20% to 18%. Deductions of net losses from taxes paid up to five years earlier. Republicans argue that all these corporate tax cuts are necessary to encourage businesses to invest more into new capital because businesses would have more income or retained earnings. And as a result it would spur the economy. Democrats disagree. They tell that businesses would notà necessary to invest; some of any tax cuts will be saved or businesses can simply to pay down their debts or to spend them for dividends to their stockholders and maybe only small part would go into new investment. Permanent cut in the former 28% tax cut rate to 25% would be accelerated to 2002. Democrats argue that this tax cut would be more effective if it will be temporary rather than permanent tax cut because this acceleration significantly shorten government revenue in later years and in the long run the government cant afford these rates cuts. Moreover, most of the tax relief would benefit only the top one-quarter of all income tax filers, who are likely to save more and spend less from tax cuts than those who have lower incomes and tend to spend whatever extra income they have. That is why Democrats support the proposal to send additional tax rebates for low-income workers, because the more rebate is spend the more effective it is as a stimulus. Democrats want to freeze marginal tax reduction in previous 39.6 bracket to 38.6% rather to decline it. It would save roughly $100 billion between 2002 and 2011. Democrats have proposed a smaller package with far fewer and temporary tax cuts and significantly more new spending 75% of the stimulus plan. They support the ways that spur consumer spending that has kept the economy afloat such as through tax rebates for lower income workers, expansions of unemployment insurance and government spending for construction and other infrastructure. For instance, temporary changes in the unemployment insurance program or any additional benefits provided would likely be spent and go directly to output. Public capital investments involve direct government purchases of goods and services and therefore directly add demand into economy.

According to the (SUSAN L. LAURE) this is goal based process which allows organization to focus on its mission and vision to achieve goals. This model does help organization to move forward and it is great practice to build a team because it offers the opportunities to let everyone in the company know that their thoughts and opinions are being considered. It lets everyone know that they belong to the organization. More over one can achieve more valuable results from a decisive approach is contract on how to make the most of the organizations capital and the in deepness perceptive of the factor that involve those resources should conditions and situation change. This model helps the organization to help to see the size of the organization in term of human resources which of course influence the main plan. It also helps organization to physical goals that they are seeking to reach. More over it provides a plan structure which makes sure constancy across distribution and each separation covers all the key aspect of the development process. The implementation of marketing planning model gives an introduction to organization to implement the strategic planning process within an organization. The management is also dependent on the high quality process consultancy and training as well as sport tools. Experience has shown that the proper planning of marketing model makes an organization to achieve its objective. L.O- 2.2 Link between strategic positioning of Disneyland Resort and marketing tactics mentioned above in the strategic marketing plan. Strategic Positioning strategic marketing plan Well there is very close link between strategic positioning and strategic marketing of Disneyland because both focus on continues growth of an organization. As far as strategic positioning is concern they conduct research to determine what the needs in order to promote are and position company where they want to. To make strategic marketing plans for organization they consider much aspect on which they can produce exactly according to needs and demands of the customers. As discussed above that marketing provides them clear room to understand the long term objective and standing of an organization. Thats how they keep on changing their strategies no matter what time of the year are they in, or no matter customers want this or not. Disney land strategic positioning provides different following questions to them, What are their strength, weaknesses, opportunities and threats? How customer takes our product? Who are the target customers? What is the image? Competitive edge? Communication to the right people? Are we able to target our product to other market? These are the question they see while undergoing the positioning for them self, if we commonly see the marketing aspect in those questions we can clearly see the link between these two terms because strategic marketing planning provides them the same kind of information in order to make their marketing plan well working. Marketing plane gives them the signs to achieve the ultimate goals while positioning based on marketing plane can point out where they exactly stands. So marketing is the key element for them to make their position where they could differentiate their product from others, because they believe to be providing the best quality products to their customers as no one does in that capability. Hence the link between these two is very common and regular infect both are dependent on each other in order to get ultimate goals. Beyond HR: the new science of human capital by john W. Boudreau, peter M. Ramstad L.O- 2.3 Related Links: Relationship Marketing | CRM | Ladder of Customer Loyalty | Benefits of Relationship Marketing | Fishbone Analysis Well as discussed above that Disney is more concern that how to retain their oncoming customers that why their current marketing strategies are based on relationship marketing which can provides them help to achieve long term objective which is to open new Disneys in other countries. Relationship marketing could provide them ultimate objective because retaining consumers for long term offers many benefits. This is also aim for the company to obtain life time custom.
